'银川市水资源管理条例(RegulationsofYinchuanMunicipalityonwaterresourcesmanagement)RegulationsofYinchuanMunicipalityonwaterresourcesmanagement2006,05,29,15:156RegulationsofYinchuanMunicipalityonwaterresourcesmanagementChapter1GeneralProvisionsArticle1forthepurposeofscientificandrationalexploitationandutilization,conservationandprotectionofwaterresources,givefullplaytothecomprehensivebenefitsofwaterresources,realizethesustainableutilizationofwaterresources,accordingtothe"People"sRepublicofChinawaterlaw","People"sRepublicofChinawaterpollutionpreventionlaw"andotherlawsandregulations,withtheactualcity,theenactmentofthisordinance.Articlesecondwhoeverdevelops,uses,saves,protectsandmanageswaterresourceswithintheadministrativeregionofthisMunicipalityshallabidebytheseregulations.WaterresourcesreferredtointheseRegulationsrefertosurfacewaterandgroundwater.Thirddevelopment,utilization,conservation,protectionofwaterresourcesshouldbecomprehensiveandoverallplanning,
comprehensiveutilization,effectiveprotection,stressingefficiency,givefullplaytothemultiplefunctionsofwaterresources,therationalallocationoflife,productionandecologicalenvironmentofwater.FourthwateradministrationdepartmentsofYinchuanmunicipalityareresponsiblefortheunifiedmanagementandsupervisionofwaterresourcesinaccordancewiththespecifiedjurisdiction.Thewateradministrativedepartmentsofcounties(autonomousregionsandmunicipalities)shallberesponsibleforthemanagementandsupervisionofthewaterresourceswithintheirrespectivejurisdictionsinaccordancewiththespecifiedpowers.Development,reform,environmentalprotection,construction,planning,landandresources,agriculture,animalhusbandry,gardenandotherdepartmentsshouldberesponsiblefortherelevantworkofwaterresourcesmanagementinaccordancewiththeirrespectiveresponsibilities.Fifthanyunitorindividualhastherighttodissuade,stopandreporttheactofendangeringthesafetyofwaterresourcesanddamagingthefacilitiesofwaterprojects.Theunitsandindividualswhohavemaderemarkableachievementsinthedevelopment,utilization,conservation,protectionandmanagementofwaterresourcesshallberewardedbythepeople"sgovernment.Thesecondchapterwaterresourcesprotection
Sixthcities,counties(cities)wateradministrativedepartmentsshouldbeinconjunctionwiththedevelopment,reform,construction,environmentalprotectiondepartmentstopreparewaterresourcesprotectionplanningandspecialplanningforwaterconservation,reportedtothepeople"sgovernmentatthesamelevelafterapproval.Theseventhcityandcounty(city)wateradministrativedepartmentinconjunctionwiththeenvironmentalprotectiondepartmentsshall,inaccordancewiththeprovisionsoftheautonomousregionofwaterfunctionzoningtotheadministrativeareasofwaterfunctionzoning,approvedbythepeople"sgovernmentatthesamelevel,andreportonthelevelofwateradministrativedepartmentsandenvironmentalprotectiondepartmentsfortherecord.City,county(city)wateradministrativedepartmentsshallbeinaccordancewiththefunctionalareasofwaterrequirementsforwaterqualityandwaterpurificationcapacityofnaturalwaters,approvedtheassimilativecapacity,thewatersofthetotalpollutantdischargelimitstotheopinionsofthecompetentadministrativedepartmentofenvironmentalprotection.City,county(city)wateradministrativedepartmentsshallorganizethewaterqualityofthewaterfunctionareamonitoring,foundthatthetotalamountofmajorpollutantsdischargedmorethancontrolindex,orqualityofwaterfunctionareadoesnotmeettherequirementsoffunctionsofthewaterareas,shallpromptlyreporttothepeople"sgovernmenttotakemeasures,andreporttotheenvironmental
protectionthecompetentadministrativedepartments.Eighthinthedesignatedgroundwaterforbiddenminingareaandrestrictedminingarea,shallnotbuildnewundergroundwaterintakeproject.Theexistingwatersupplywellsintheprohibitedgroundwaterexploitationareashouldbeclosedbythemunicipal,county(District,city)people"sgovernmentsinaccordancewiththelaw,andthewatersupplywellsintheconfinedgroundwaterexploitationareashouldbecutdownyearbyyear.Ninth,establishdrinkingwatersourceprotectionzonesystem.City,county(city)people"sgovernmentshouldannouncethedrinkingwatersourceprotectionareadesignatedbythesociety,andtakeeffectivemeasurestopreventwatersourcedepletionandwaterpollution,andensurethesafetyofdrinkingwaterforurbanandruralresidents.Thetentharticleprohibitsthefollowingbehaviorsinthedrinkingwatersourceprotectionarea:(1)setupasewageoutlet;(two)excavateselfsupplywaterwell;(three)projectstodischargepollutantsintowaterbynewlyconstructedorrebuiltprojects;(four)constructionofgarbagedump,largefarmsandcemeteries;
(five)theuseofseepagepits,infiltrationwellssewage;(six)otheractsprescribedbylawsandregulations.Theeleventhprohibitsthedumpingofgarbage,wasteresidueanddebrisinrivers,ditches,channels,scenicspotsandwaterbodies,lakes,andpollutedwaterbodies.Theexplorationofthetwelfthwatersourcesshouldbeapprovedbythemunicipalandcounty(city)wateradministrativedepartmentsaccordingtotheprescribedauthority,andtheconstructionunitshallcarryouttheconstructioninaccordancewiththeapprovedscopeanddepth.Thirteenthinthewaterchannel,channels,lakesandothernew,renovationorexpansionofthesewageoutfall,shallbeapprovedbytheDepartmentofwateradministration,bythecompetentadministrativedepartmentofenvironmentalprotecttheenvironmentimpactontheconstructionprojectevaluationreport(table)forapproval.Fourteenthpeople"sgovernmentsatalllevelsshouldstrengthentheconstructionofurbansewagetreatmentfacilities,urbansewagetreatmentshouldbecarriedoutaccordingtotheprovisions,toachievedischargestandards.Fifteenthmunicipalandcounty(District,city)wateradministrativedepartmentsshouldestablishwaterresourcesreal-timemonitoringinformationmanagementsystemandwaterqualitymonitoringstationnetwork,thesurfacewaterandgroundwaterlong-termdynamicmonitoring.
Sixteenthindustrialwatershouldadoptadvancedtechnology,processandequipment,improvethereuserateofwater.Waterquotaofvariousindustriesshallbeimplementedaccordingtothestandardspromulgatedbythepeople"sGovernmentoftheautonomousregion.Seventeenthpeople"sgovernmentsatalllevelsandrelevantdepartmentsshouldguideagriculturalgrowerstoadjusttheplantingstructureandlayoutofcrops,adoptcomprehensivewater-savingmeasures,developefficientwater-savingagricultureandecologicalagriculture.Inagriculturalproduction,chemicalfertilizersandpesticidesshouldbeappliedscientificallytopreventpollutionofwaterbodiesbyexcessiveuseofchemicalfertilizersandpesticides.EighteenthprohibitsthelakereclamationandothernarrowLakewetlandareabehavior.Iftheconstructionofurbanpublicfacilitiesandroadsneedstooccupytheland,spaceandwatersurfaceofthelakewetlandprotectionarea,itshouldbeapprovedbythelakewetlandmanagementinstitutionandsubmittedtotheMunicipalPeople"sgovernmentforapproval.Nineteenth,becauseofurbanconstructionorpumpingwellsscrappedandotherreasonsneedtosealthepumpedwell,theunitshouldbeinaccordancewiththerelevanttechnical
specificationsinthecity,county(District,city)wateradministrativedepartmentsunderthesupervisionoffilling.ThethirdchapterwaterresourcesdevelopmentandutilizationWaterresourcesdevelopmentandutilizationoftwentieth,shouldadheretothepriorityofdevelopmentandutilizationofsurfacewater,strictlycontroltheexploitationandutilizationofgroundwater,waterofurbanandruralresidentstomeetthefirst,takingintoaccounttheindustry,agriculture,ecologicalandenvironmentalwaterandotherwaterindustry.Thetwenty-firstcityandcounty(city)wateradministrativedepartmentsshall,accordingtotheneedsofsocialdevelopment,inconjunctionwiththedevelopmentandreform,constructionandotherdepartmentsforcomprehensivedevelopmentandutilizationofwaterresourcesplanning,approvedbythepeople"sgovernmentatthesamelevelaftertheimplementationof.Thetwenty-secondpeople"sgovernmentsatalllevelsshouldrestricttheindustrial,agriculturalandserviceprojectsofhighwaterconsumptioninlightoftheactualsituationofwaterresourcesintheregion.Thetwenty-thirdminingandutilizationofundergroundwatershallnotexceedthetotalrecoverableamountofthisyear.Thetotalamountofgroundwaterplanning,theoveralllayoutofwellpointsandthewaterintakehorizonshallbedeterminedbythedevelopmentandReformDepartmentofthecity,county
(city)andthewateradministrativedepartmentatthesamelevel.Twenty-fourthdirectlyfromthelakeorundergroundwaterandtheneedtoapplyforwaterpermitconstruction,renovationandexpansionoftheconstructionproject,constructionprojectapproval,theconstructionunitshallcarryoutwaterresourcesassessmentinaccordancewiththeprovisionsofthepreparationoftheconstructionprojectwaterresourcesdemonstrationreport.Twenty-fifthnewconstruction,expansion,reconstructionoftheconstructionproject,shoulddevelopwater-savingmeasures,supportingtheconstructionofwater-savingfacilities.Watersavingfacilitiesshouldbedesigned,constructedandputintoproductionsimultaneouslywiththemainproject.Forthetwenty-sixthproject,thewateradministrativedepartmentshoulddeclarethewaterintakeplanandthewaterreuseplan.City,county(city)wateradministrativedepartmentsshouldbeacceptedinaccordancewiththeprovisionsoftheauthority.Twenty-seventhpeople"sgovernmentsatalllevelsshouldincorporatetheconstructionofcentralizedsewagetreatmentfacilitiesintourbandevelopmentplanning,andencouragetheuseofreclaimedwaterinthereclaimedwaterindustry.Thetwenty-eighthistoencouragequalifiedunitsandindividualstoscientificallyexploitandutilizerainwaterandbrackishwaterresources.
ThefourthchapterwaterintakemanagementArticletwenty-ninthanyunitorindividualwhouseswaterengineeringormechanicalwaterliftingfacilitiestodirectlyfetchwaterfromrivers,lakesorunderground,shallapplyforwaterdischargelicensesinaccordancewiththelawsandregulations.Thirtiethnewwaterwellsinthecityarea,thecitywateradministrativedepartmentsinaccordancewiththeapprovalofthejurisdictionofthepeople"sGovernmentoftheautonomousregionapproval.County(city)underthejurisdictionwithinthescopeofthenewdrillingwaterwells,thecounty(city)wateradministrativedepartmentapprovalauthorityinaccordancewiththeprovisionsoftheAutonomousRegionPeople"sgovernmentforapproval.Cuttoreachthepublicownedwaterwellswatersupplynetworkincityplanningareawithintheapplication,theDepartmentofwateradministrationshallsolicittheopinionsofthecompetentdepartmentofconstruction,theconstructionadministrativedepartmentshallsolicitopinionsofthematerialswithin5workingdaystoputforwardtheirviewsandtosendthewateradministrativedepartmentofreceipt.Thirty-firstofthefollowingcircumstancesdonotneedtoapplyforwaterlicense:
(1)theruralcollectiveeconomicorganizationsandtheirmembersusethewaterinthereservoirsandreservoirsofthecollectiveeconomicorganizations;(two)asmallamountofwaterintake,suchasfamilylife,sporadicfeeding,livestockandpoultryfeeding,etc.;(three)inordertoensurethesafetyandproductionsafetyofundergroundengineeringsuchasmine,itisnecessarytotaketemporaryemergencywaterintakeordrainage;(four)temporaryemergencywaterwithdrawalinordertoeliminatetheharmtopublicsafetyorpublicinterest;(five)temporaryemergencywaterintakemustbetakenforagriculturaldroughtresistanceandmaintenanceofecologyandenvironment.Asmentionedintheprecedingparagraph(three),(four)waterprovisions,shallpromptlyreporttothemunicipal,county(city)wateradministrativedepartmentsfortherecord;(five)waterprovisions,shallbeapprovedbythecityandcounty(city)totheDepartmentofwateradministration.Thirty-secondofthefollowingcircumstances,theexaminationandapprovalauthoritiesmaylimittheannualwaterintakeofthewatertakingunitorindividual:(1)becauseofnaturalreasons,watersourcescannotmeetthenormalwatersupplyinthisarea;
(two)waterintakeandwaterwithdrawalhaveaseriousimpactonthewaterfunctionarea,waterusefunction,ecologyandenvironment;(three)severegroundwateroverdraftorgroundsubsidencecausedbygroundwaterexploitation;(four)thereareotherspecialsituationsthatneedtolimittheamountofwatertaken.Incaseofseriousdrought,theexaminationandapprovalauthoritiesmaymakeemergencyrestrictionsontheamountofwatertakenbytheunitsorindividualswhotakethewater.Thirty-thirdmineralwaterandgeothermalwaterthathavebeenprovedshallbeappliedtothemunicipalwateradministrationdepartmentforwaterintakelicense,andthemininglicenseshallbedealtwithbytheadministrativedepartmentoflandandresourceswiththepermitofwaterintake.Thirty-fourthwaterpermitimplementationoftheauditsystem.ThePermitHoldershallinstallwatermeteringfacilitiesqualifiedinthewaterintake,andinaccordancewiththeprovisionsofthewaterintakepermit;notinstalledornottimelyreplacementofmeteringfacilitiesdamagedinaccordancewiththeprovisionsofthecityandcounty(city)wateradministrativedepartmentsshallbeordereddeadlinetoinstallorreplace;failstoinstallorreplacethewaterresources.Forwaterfacilities24hoursofcontinuousmaximumwatercollectingamount.
Thethirty-fifthwitnessshoulddowellthestatisticsofwaterintakeandestablishtheannualreport,quarterlyreportandmonthlyreportsystem.Whenthewateradministrativedepartmentconductstheexamination,theholdershouldcooperatetoprovidetherelevantdataforthedeterminationofwaterintake.Thirty-sixthsinkingconstructionunitsshouldhavethecorrespondingqualificationlevel,andcomplywiththefollowingprovisions:(1)constructioninaccordancewiththeconstructiondesignscheme;(two)hydrogeologicaldatashouldbeobtainedbygeophysicalprospectingbeforecompletionofwellconstruction;(three)thelayoutandwaterintakelevelofthewellcannotbearbitrarilychangedorenlarged,andthemixedlayerminingshallnotbecarriedout;(four)dowellthemeasureoflayeredwatersealing,andthesaltwaterlayershouldbeclosedtightly.Afterthecompletionoftheconstructionofthirty-seventhwells,Itshouldbecheckedandacceptedinaccordancewiththerelevantprovisions,andthequalifiedonescanbeputintouse.
Theconstructionunitshallfilerelevantinformationtotheadministrativedepartmentofwaterfortherecord.Thethirty-eighthprohibitsanyunitsandindividualsfromthebuildings,structureswithin30metersrangeofshallowwells.Thethirty-ninthwatersuppliedbythewatersupplyprojectshouldpaythewaterfeetothewatersupplyunitaccordingtotheregulations.Fortheunitsandindividualswhodirectlydrawwaterfromthesurfaceorunderground,thewateradministrativefeesofthemunicipalandcounty(city)administrativedepartmentsshallbeleviedaccordingtotheprovisions,exceptthoseexemptedfromtheprovisionsofthestate.ThefifthchapterislegalresponsibilityFortiethinthedrinkingwatersourceprotectionzonesetupsewageoutfall,municipalandcounty(city,district)people"sGovernmentshalldismantlerestitution;overduedemolition,restitution,forceddemolition,restitution,andsentencedto50thousandyuanfineof100thousandyuan.Forty-firstintheareaoflandfillconstruction,largefarmsandcemeterydrinkingwatersourceprotection,theuseofseepagepits,infiltrationwellsandotherimpropermeanstodischargesewage,municipalandcounty(city,district)administrativedepartmentsinaccordancewiththeprovisionsofthewaterrightsshallbeorderedtostoptheillegalact,totakeremedialmeasures,inadditionto50thousandyuanfine
of100thousandyuan.Forty-secondwithoutthewateradministrativedepartmentforexaminationandapproval,withoutauthorizationinthechannel,channel,water,Lakescenicareaconstruction,renovationorexpansionofthesewageoutfall,municipalandcounty(city,district)administrativedepartmentsinaccordancewiththeprovisionsofthewaterrightsshallbeorderedtostoptheillegalact,restitution,andsentencedtomorethan50thousandyuanafineof100thousandyuan.Watersavingfacilitiesforty-thirdconstructionprojectswithoutconstructionornotmeetthestaterequirements,unauthorizeduseofinputs,bycityandcounty(city,district)administrativedepartmentsinaccordancewiththeprovisionsofthewaterrightsshallbeorderedtostopusing,makecorrections,andimpose50thousandyuanfineof100thousandyuan.Forty-fourthinthedrinkingwatersourceprotectionareaswithoutdiggingownedwaterwells,municipalandcounty(city,district)administrativedepartmentsinaccordancewiththeprovisionsofthewaterrightsshallbeorderedtostoptheillegalact,alandfillwells,restitution,andsentencedto20thousandyuanfineof100thousandyuan.Forty-fifthproduction,saleoruseofobsoleteandbackward,thewaterconsumptionofhightechnology,equipmentandproductsintheproductionandmanagement,bythepeople"sgovernmentsatorabovethecountyleveltradedepartmentorderedtostopproduction,saleoruse,rangingfrom20
thousandyuanto100thousandyuanfine.Articleforty-sixthviolationofthisOrdinance,anyofthefollowingacts,bycityandcounty(city)administrativedepartmentsinaccordancewiththeprovisionsofthewaterrightsshallbeorderedtostoptheillegalact,alandfillwellsortakeremedialmeasures,andimposea20thousandyuanfineof100thousandyuan:(1)waterwithdrawalwithoutapproval;(two)failingtotakewateraccordingtotheapprovedwaterintakesite;(three)thewaterisnottakenaccordingtothedepthoftheapprovedwaterintake;(four)failingtodrawwaterinaccordancewiththeapprovednumberofsinkingwells;(five)failingtocarryoutthemixedlayerexcavationaccordingtotheprescribedwaterintakelevel;(six)itisnotstrictlylayeredtopreventwaterfrompollutingorleavingserioushiddendangers;(seven)shallowwellsarewithin30metersofbuildingsandstructures.Forty-seventh,totheriverchannel,channel,scenicarea,lakewater,wastedumpgarbageanddebris,lakereclamationor
unauthorizedreclamation,bycityandcounty(city,district)administrativedepartmentsinaccordancewiththeprovisionsofthewaterrightsshallbeorderedtostoptheillegalact,totakeremedialmeasures,inadditiontothe10thousandyuanfineof50thousandyuan.Article48withoutobtainingapprovaldocumentsforwaterintakeprojectorfacilityconstructionwithoutauthorization,shallbeorderedtostoptheillegalbehavior,deadlineforcompletingtheformalities;overduecompletingorresubmitisnotapproved,shallbeorderedtodismantleorclosedorthewaterengineeringfacilities;Overduedemolitionorclosureorfacilitiesforwaterintakeproject,bythewateradministrativedepartmentofthelocalpeople"sgovernmentsatorabovethecountyleveldismantledorclosed,thecostbornebytheviolator,maybefined50thousandyuan.Forty-ninththeapplicantconcealsrelevantinformationorprovidesfalsematerialsforwaterforwaterpermitorapprovaldocuments,approvaldocumentsorwaterintakepermitinvalid,bytheexaminationandapprovalauthoritiesinaccordancewiththeapprovalauthorityoftheapplicantshallbegivenawarning,orderedtofillthewaterresourcefeepaidshallbepaid,afineof20thousandyuanand100thousandyuanof;acrime,criminalresponsibilityshallbeinvestigatedaccordingtolaw.Thequantityofwatertomakefiftiethrefusedtocarryouttheexaminationandapprovalauthoritiesdecidedtolimit,or
unauthorizedtransferofwaterright,bytheexaminationandapprovalauthoritiesinaccordancewiththeexaminationandapprovalauthorityshallbeorderedtostopillegalactivities,withinatimelimit,afineof20thousandyuanand100thousandyuan;thosewhorefusetocorrectorthecircumstancesareserious,thewaterpermitrevoked.Fifty-firstofthefollowingactsshallbeorderedtostoptheillegalact,makecorrectionswithinatimelimit,afineofmorethan5000yuanandlessthan20thousandyuan;ifthecircumstancesareserious,thewaterwithdrawallicenseshallberevoked:(1)failingtosubmittheannualwaterintakeinaccordancewiththerelevantprovisions;(two)refusetoacceptsupervisionorcheckormakefalse;(three)thequalityofthereturnedwatercannotmeetthespecifiedrequirements.Fifty-secondorrefusingtopaythearrearsofwatercharges,municipalandcounty(city,district)wateradministrativedepartmentsaccordingtotheirrespectivefunctionsandpowersshallbeorderedtopay;overduepayment,startingfromthedayof2/1000levyanextrapaymentfromthefirstday,shallbeliabletopayorpaythewaterresourcefeeofmorethanfivetimesthefine.Ifthefifty-thirdpartyrefusestoacceptthedecisiononadministrativepenalty,heorshemayapplyforadministrative
reconsiderationorbringanadministrativelawsuitaccordingtolaw.Iftheapplicantfailstoapplyforreconsideration,doesnotbringalawsuitandfailstoperformtheadministrativepenaltydecision,thedepartmentmakingtheadministrativepenaltydecisionshallapplytothepeople"scourtforcompulsoryexecution.Fifty-fourthpersonswhoneglecttheirduties,abusetheirpowerandengageinmalpracticesforpersonalgainsshallbegivenadministrativesanctionsaccordingtolaw;ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw.ThesixthchaptersupplementaryprovisionsThefifty-fifthregulationsshallcomeintoforceonMay1,2006.StandingCommitteeofthepeople"sCongressofYinchuanMunicipalityTwoMarch31st,six'
